PART 1 – TERMS AND CONDITIONS ("Terms")

1. Acceptance of the Terms

These Terms constitute a legally binding agreement between you ("User", "you") and TouchlineKE ("TouchlineKE", "we", "our" or "us"). By downloading, installing, accessing or using the TouchlineKE mobile application (the “App”), you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the App.

2. About TouchlineKE

TouchlineKE is a free, ad-supported platform designed to increase engagement with Kenyan rugby by providing match schedules, scores, standings and a community “Banter” section where fans can post and discuss rugby-related topics (text, images, videos). Content focuses on matches and tournaments held in Kenya or featuring Kenyan teams worldwide (e.g., World Rugby Sevens Series).

3. Eligibility & Accounts

• You may view public content without registering.
• Posting or interacting requires creating an account using email or third-party sign-in (Google/Facebook).
• You must provide accurate information (name, username, email). You may delete your account at any time within the App settings.
• You are responsible for maintaining the confidentiality of your login credentials. All activities under your account are deemed to be yours.

4. User Content & Community Rules

1. Ownership: You retain all rights to content you upload. TouchlineKE does not claim ownership.
2. Licence: By posting, you grant TouchlineKE a worldwide, non-exclusive, royalty-free licence to display and distribute your content within the App for the purpose of operating and improving the service.
3. Rules: Posts must:
   • Relate to rugby.
   • Use decent language; no hate speech, harassment, spam, pornography, defamation or illegal content.
4. Moderation: We may remove content, suspend or permanently ban accounts that violate these rules. Decisions are at our sole discretion.

5. Intellectual Property

We own the App name “TouchlineKE”, the logo, design, and underlying code. Unauthorized use is prohibited. Users may reuse factual match data and public content posted within the App, provided such reuse complies with applicable laws and the rights of original content creators.

6. Advertisements

The App is supported by advertisements delivered via Google AdMob. Ad content is provided by third-party networks; we are not responsible for their accuracy or reliability.

7. Prohibited Activities

You agree not to:

• Reverse-engineer or attempt to extract source code of the App.
• Introduce malware or interfere with operation of the App or networks.
• Harvest data or use automated scripts.
• Impersonate others or misrepresent your affiliation.

8. Updates & Termination

We may modify, suspend or terminate the App (or any part) at any time without liability. We may revise these Terms; changes take effect once posted in-App. We will notify users of material changes.

9. Disclaimer & Limitation of Liability

The App and all content are provided “as is” without warranties of any kind. To the fullest extent permitted by Kenyan law, TouchlineKE disclaims all liability for damages arising from your use of the App, including user-generated content and third-party ads.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any dispute shall be submitted to the exclusive jurisdiction of Kenyan courts.

PART 2 – PRIVACY POLICY

1. Introduction

Your privacy is important to us. This Privacy Policy explains how TouchlineKE collects, uses, stores and protects your information when you use the App.

2. Information We Collect

We do NOT collect: precise location, contact lists, usage analytics, or payment information.

3. How We Use Information

• Create and manage your account.
• Display your posts and facilitate banter interactions.
• Send push notifications (match reminders, replies, etc.).
• Serve personalised or contextual ads via Google AdMob.
• Maintain the security and integrity of the App.

4. Legal Basis

We process personal data on the basis of:

• Your consent (when you register or grant permissions).
• Contractual necessity (to deliver the App’s core functions).
• Legitimate interests (to improve and secure the service).

5. Data Sharing & Disclosure

• We do not sell or rent personal data.
• We share data only with service providers necessary to operate the App (Firebase, Google AdMob) under strict data-processing agreements.
• Content you post is visible to other users worldwide.

6. Storage & Security

Data is stored on Google Firebase servers located in secure facilities. We implement technical and organisational measures (encryption in transit, access controls) to safeguard information. No method of transmission is 100% secure; we cannot guarantee absolute security.

7. Data Retention & Deletion

• We retain your data as long as your account is active.
• You may delete your account at any time from in-App settings; this removes your personal profile data from our servers. Certain content (e.g., messages already posted) may remain visible but anonymised.
• Unverified accounts older than 7 days may be removed as part of routine maintenance.

8. Children’s Privacy

TouchlineKE is not directed to children under 13. If we learn that we have collected personal data from a child under 13 without parental consent, we will delete it.

9. International Transfers

Data may be processed outside Kenya (e.g., Google Cloud data centres). We rely on Google’s compliance frameworks to protect international transfers.

10. Your Rights

Subject to Kenyan law, you may:

• Access the personal data we hold about you.
• Request correction or deletion of your data.
• Withdraw consent at any time.
• Object to certain processing.

11. Changes to This Policy

We may update this Privacy Policy. We will notify users of material changes via the App or email. Continued use after changes constitutes acceptance.
